PROGETTIAMO EVENTI di Siricola Anna is the owner of the brand FIRMIAMO LE TUE CREAZIONI®, a registered trademark protected by law (registration no. 302024000117286 consultable on the UIBM - Italian Patent and Trademark Office website https://www.uibm.gov.it/bancadati/Number_search/type_url?type=wpn)
1.3. The submission of the order implies full acceptance of these General Terms and Conditions of Sale (GTC) and the declaration of having read the privacy policy.
1.4. Pre-contractual information
Before the conclusion of the contract, FIRMIAMO® provides the consumer with the following essential information (Articles 49 et seq. of the Consumer Code; Directive 2011/83/EU):
- Main characteristics of the products (descriptions, materials, dimensions)
- Total price including taxes and ancillary costs
- Payment, delivery and execution methods
- Legal and commercial guarantees
- Customer service and complaints
1.5. Customer Support
Pre-sales and after-sales support is guaranteed through the contacts indicated in art. 1.1 during the following hours: Monday-Friday 9:00 AM - 6:00 PM.
Art. 2 – WHAT WE SELL | Subject and Products Offered
2.1. FIRMIAMO® products include handcrafted tools, molds and accessories for cake design, confectionery and related sectors.
In particular, these are creative physical products such as:
§ Customized tools for confectionery decoration: molds, stamps, stencils, cutters, toppers, textures, Alfabello® sets, Biscrostate® etc.
§ Limited editions and seasonal collections related to trends and creative events.
2.2. Regulatory compliance: All FIRMIAMO® products made of PLA comply with current regulations on Food Contact Materials and Objects (FCMs), and can be accompanied by specific FCM compliance certificates, available upon request, in accordance with the following regulations:
- Ministerial Decree of March 21, 1973 and subsequent amendments.
- EC Regulation 1935/2004
- EU Regulation 10/2011
2.3. The brands ALFABELLO® and BISCROSTATE® are registered and protected by law (respectively, registrations no. 302024000117226 and no. 302024000117268, consultable on the UIBM - Italian Patent and Trademark Office website https://www.uibm.gov.it/bancadati/Number_search/type_url?type=wpn).
2.4. Mandatory instructions for use: The use and maintenance of the products must strictly follow the Instructions for Use provided with each product (e.g., hand washing, no dishwasher, avoid high temperatures beyond the indicated limits).
2.5. FIRMIAMO® is not responsible for damages resulting from improper use, unauthorized modifications, or failure to follow the instructions for use.
2.6. Product availability
Products are sold while supplies last. In case of unexpected unavailability, even after order confirmation, FIRMIAMO® will promptly inform the customer.
The customer can choose between:
- replacement with another product of equivalent value;
- issuance of a purchase voucher to be used within 12 months;
- immediate refund of sums already paid, to be made within 14 days of communication.
Art. 3 – PRICES | Policy and Promotions
3.1. Prices:
All prices are expressed in Euro (€).
· For Italy and EU27(*) customers: prices include VAT
· For extra-EU customers (e.g., Switzerland): VAT is not applicable pursuant to art. 8 of DPR 633/72. The customer remains responsible for the payment of any duties, local taxes and customs fees required by the authorities of the destination country.
(*) EU27 Europe: Austria, Belgium, Bulgaria, Cyprus, Croatia, Denmark, Estonia, Finland, France, Germany, Greece, Ireland, Latvia, Lithuania, Luxembourg, Malta, Netherlands, Poland, Portugal, Czech Republic, Romania, Slovakia, Slovenia, Spain, Sweden, Hungary.
3.2. Price validity:
The applicable prices are those displayed at the time of order confirmation and
cannot be unilaterally modified after such confirmation.
Any variations in list prices will apply exclusively to subsequent orders.
3.3. Registration PROMOTION:
New customers who complete registration on the website, providing all requested data (name, surname, full address, phone, email, tax code or VAT number) receive a 10% discount code valid for their first order:
· The discount is strictly personal, non-transferable, and cannot be combined with other promotions
· Validity: 90 days from registration
· Usage: once per customer
3.4. Tiered SHIPPING cost policy
Reference: for details on shipping rates, see Art.5.3. These shipping conditions must be read and interpreted jointly with Art. 5 – Shipments and Deliveries, which details operational methods, timelines, exclusions and the management of special cases.
Art. 4 – PAYMENTS and Order Completion
4.1. Accepted payment methods:
- PayPal (immediate debit)
- Credit/debit cards: Visa, Mastercard (immediate debit)
- Advance ordinary bank transfer, not instant (order processed after credit) to be paid to IBAN IT65R3608105138995664395672 in the name of Progettiamo Eventi di Siricola Anna, at Poste Italiane SpA
4.2. Completion: The order is considered definitively completed and binding upon successful payment and the sending of the confirmation email by FIRMIAMO®.
4.3. Security: All online payments are protected by a certified SSL connection. FIRMIAMO® does not store credit card data.
4.4. Failed payments: In case of non-payment, the order is automatically cancelled after 7 days.
Art. 5 – SHIPMENTS, Deliveries and Delays
5.1. Shipping methods
Shipments are made from FIRMIAMO®'s operational headquarters via express courier for all orders from the website www.firmiamoletuecreazioni.com
5.2. Transfer of risk
· For consumers (B2C)*: The risk of loss or damage to the goods remains with FIRMIAMO® until actual delivery to the consumer or a person designated by them (Art. 63 Consumer Code).
· For professional customers (B2B)*: The risk transfers at the time of delivery to the carrier, pursuant to Art. 1510 of the Civil Code. FIRMIAMO® maintains full assistance to the professional customer for any claims against the carrier.
* Consumer (B2C): means a natural person who acts for purposes unrelated to their business, commercial, craft or professional activity.
* Professional (B2B): means a person who acts for purposes related to their business, commercial, craft or professional activity.
5.3. Tiered shipping RATES
· Orders under €20.00 → shipping costs €7.50 (only Italy including Major Islands, Vatican City and San Marino; excluding Minor Islands, Disadvantaged Areas and abroad)
· Orders from €20.00 to €90.00 → shipping costs
a - with standard courier (approx. 5 days) €5.90 (only Italy, including Major Islands, Vatican City and San Marino; excluding Minor Islands, Disadvantaged Areas and abroad)
b - with express courier (approx. 2 days) €6.90 (only Italy, including Major Islands, Vatican City and San Marino; excluding Minor Islands, Disadvantaged Areas and abroad)
· Orders from €90.00 to €210.00 → FREE shipping (only Italy, including Major Islands, Vatican City and San Marino; excluding Minor Islands, Disadvantaged Areas and abroad)
· Orders over €210.00 → FREE shipping throughout Italy (including Minor Islands and Disadvantaged Areas) and to EU27 foreign countries (but excluding extra-EU countries, such as Switzerland).
5.3.1. SPECIAL RATES - Minor Islands and Disadvantaged Areas, Europe, Extra-EU
- Minor Islands and Disadvantaged Areas (Lampedusa, Pantelleria, Ischia, Capri, Tremiti, etc.): unless free for orders over €210.00, fixed rate €9.90
- EU Europe : unless free for orders over €210.00, fixed rate €19.90
- Extra-EU countries (e.g., Switzerland ): fixed rate € 29.90 . Any additional duties, taxes and customs charges remain the responsibility of the recipient.
5.4. Processing and delivery TIMES
Processing and delivery times are estimated based on experience and do not constitute a binding contractual commitment, unless otherwise agreed in writing. The consumer's rights remain unaffected in case of delay beyond the legal terms provided by Art. 61 of the Consumer Code.
· Order processing: 1–3 business days from payment confirmation. Customizations and made-to-order items require 5-7 business days, compatible with artisanal production.
· Estimated average delivery from courier pickup:
- Italy: 2–3 business days
- Islands: 3–5 business days
- EU27 Europe: 3-5 business days
- Extra-EU, e.g., Switzerland: 5–8 business days (including customs operations)
5.5. Shipment TRACKING
For every shipment made by courier, a tracking code is provided to monitor the delivery status in real time.
5.6. Delivery delays (for consumer customers, pursuant to art. 61 Consumer Code)
· FIRMIAMO® undertakes to deliver the products within 30 days from the conclusion of the contract, unless otherwise agreed with the consumer.
· In case of non-delivery within this period, the consumer may grant FIRMIAMO® an appropriate additional period.
· If this period also elapses without result, the consumer has the right to terminate the contract, to an immediate refund of the sums already paid and, where applicable, to compensation for damages within the limits of the law.
· If compliance with the original deadline is essential (e.g., deliveries for dated events or urgent customizations), the consumer may immediately terminate the contract without having to set an additional deadline.
Art. 6 – Right of Withdrawal and RETURNS
6.1. The right of withdrawal is granted exclusively to the consumer customer (B2C) pursuant to articles 52-59 of Legislative Decree 206/2005 (Consumer Code) and can be exercised within 14 days of receiving the product. It is not provided for professional customers (B2B).
6.2. Exclusions from withdrawal:
The right of withdrawal does not apply to:
- Products made to measure or clearly customized
- Opened products that cannot be resold for hygiene or health reasons
- Products that deteriorate rapidly
6.3. Method of exercise:
Written communication within 14 days of receipt, alternatively:

· using the Standard EU Withdrawal Form compliant with Annex I-B of Directive 2011/83/EU, downloadable from the "Withdrawal" section of the website at the following link: www.firmiamoletuecreazioni.com/recesso
Product return: Within a further 14 days from communication
6.4. Conditions for return:
· Products must be intact, unused, in their unopened original packaging
· Return shipping costs are borne by the customer (unless the product is defective)
· Return address: FIRMIAMO® - PROGETTIAMO EVENTI di Siricola Anna, via Pomaretto 6/B - 10135 Turin
6.5. Refund:
FIRMIAMO® will refund the product price (excluding original shipping costs) within 14 days of receiving the return, using the same payment method as the purchase.
6.6. Defective products: Return costs are borne by FIRMIAMO®.
6.7. Cross-border withdrawal :
For purchases made by consumers residing in other European Union Member States, the provisions of the consumer's country of residence apply, within the limits and in compliance with the Directive 2011/83/EU on consumer rights.
Article 6-bis – Right of Reconsideration (beyond legal withdrawal)
6-bis.1. Regardless of the right of withdrawal provided for in Articles 52-59 of the Consumer Code, FIRMIAMO® grants the customer a conventional right of reconsideration of 30 days from product delivery.
6-bis.2. This right applies exclusively to products that are:
· not personalized,
· not perishable,
· returned intact, unused, and in their original packaging.
6-bis.3. Return costs remain the responsibility of the customer, except in cases of product defects or non-conformity.
6-bis.4. Following the exercise of the right of reconsideration, FIRMIAMO® will refund the product price within 14 days of receiving the return, using the same payment method used by the customer for the purchase.
Article 7 – Legal Guarantee of Conformity
7.1. Legal Guarantee
All FIRMIAMO® products are covered by the legal guarantee of conformity provided by the Consumer Code (Articles 128–135) for consumers, with a duration of 24 months from delivery. For professional customers (B2B), the guarantee is 12 months as per Article 1490 c.c.
7.2. Reporting defects
Any conformity defects must be reported within 2 months of discovery (for consumers) or within 8 days (for professional customers), under penalty of forfeiture.
7.3. Remedies in case of non-conformity
In the event of ascertained non-conformity, the consumer is entitled to the following remedies, applied in the order established by Article 130 of the Consumer Code:
- Free repair or replacement of the product (at the consumer's choice, unless the chosen remedy is objectively impossible or excessively burdensome for FIRMIAMO®).
- Proportional price reduction or contract termination with full refund, only if repair or replacement is impossible, excessively burdensome, or has not been carried out within a reasonable period.
7.4. Burden of proof
Within the first 24 months from delivery, it is presumed that the defect already existed at the time of delivery, unless proven otherwise.
Article 7-bis – Additional Commercial Guarantee
7-bis.1. In addition to the legal guarantee of conformity provided for in Articles 128-135 of the Consumer Code (24 months for consumers and 12 months for professionals), FIRMIAMO® offers a free conventional commercial guarantee exclusively for products of the ALFABELLO® and related lines, with the following conditions:
· ALFABELLO® TRACK: 36 total months (24 legal + 12 commercial), for a maximum of three (3) replacements in case of breakage due to normal use.
· ALFABELLO® LETTERS: 36 total months (24 legal + 12 commercial), for a maximum of five (5) replacements in case of breakage due to normal use. For each shipment of replacement letters, the customer may receive the guaranteed pieces together with a new minimum order of €20.00 (excluding shipping costs).
This threshold does not limit the right to the guarantee, which remains free, but allows for optimizing shipments by combining replacements with new purchases, with a view to sustainable and responsible logistics management.
7-bis.2. The commercial guarantee is voluntary and free and does not limit or replace the consumer's rights deriving from the legal guarantee, which remain unaffected.
7-bis.3. To avail of the commercial guarantee, the customer must:
· submit a written request to FIRMIAMO®, attaching proof of purchase and a photo of the damaged product;
· comply with the instructions for use provided with the product.
7-bis.4. Excluded from the commercial guarantee are:
· damage resulting from improper use, exposure to temperatures beyond limits, dishwashing, or other methods contrary to instructions;
· unauthorized modifications to products;
· normal wear beyond the provided replacement limits.
Article 8 – LIABILITY and Force Majeure
8.1. Causes of exemption
FIRMIAMO® is not liable for delays or service disruptions due to:
· force majeure (exceptional, unforeseeable and unavoidable events, such as natural disasters, wars, general strikes, acts of authority, pandemics);
· carrier disruptions not attributable to FIRMIAMO®;
· inaccuracies or incompleteness in the delivery address provided by the customer.
8.2. Customer obligations
The customer must provide a correct and manned delivery address. Any costs for storage, attempted delivery or re-delivery due to their responsibility shall be borne by them.
8.3. Limitations of liability
FIRMIAMO® is liable for direct and indirect damages foreseeable at the time of contract conclusion, arising from non-performance or product defects,
within the limits allowed by the Consumer Code.
Liability for unforeseeable damages or damages not directly attributable to non-performance is excluded, except in cases of willful misconduct or gross negligence.
8.4. Hardship Clause (Extraordinary Events)
- In the event of extraordinary, unforeseeable and unforeseen events that, without constituting force majeure, make the performance of the contract excessively onerous for one of the parties (pursuant to Article 1467 c.c.), FIRMIAMO® and the customer undertake to renegotiate the contractual conditions in good faith, with the aim of restoring the original balance of the contract.
- If an agreement cannot be reached within 30 (thirty) days from the start of renegotiation, each party may request the termination of the contract, without prejudice to the customer's right to reimbursement of sums already paid and not enjoyed.
Article 9 – PERSONAL DATA and PRIVACY Processing
9.1. GDPR Compliance:
FIRMIAMO® processes personal data in full compliance with EU Regulation 2016/679 (GDPR) and Legislative Decree 196/2003 as amended by Legislative Decree 101/2018.
9.2. Purpose of processing:
The personal data collected are processed exclusively for:
- Processing, fulfillment and shipping of orders
- Invoicing and mandatory tax obligations
- Communications related to orders and customer support
- Management of promotions for registered users (with prior consent)
- Legal obligations
9.3. Full information:

Article 10 – INTELLECTUAL PROPERTY and Communications
10.1. All website content (texts, images, photographs, logos, trademarks, graphics, layout) is protected by FIRMIAMO® or authorized third parties' intellectual property rights. Any reproduction, distribution, or commercial use without written authorization is prohibited.
10.2. Official communications must be managed via email to the addresses provided. The customer undertakes to keep their email address updated.
Article 11 – Dispute Resolution and Competent Court
11.1. Applicable law:
These GTC are governed exclusively by Italian law.
11.2. Competent court:
· Consumers resident in Italy: court of the consumer's place of residence or domicile (Art. 66-bis Consumer Code)
· Professional customers: Court of Turin
11.3. Alternative dispute resolution:
· Conciliation: Consumers can contact the Chambers of Commerce for conciliation procedures
· Mediation: Possibility of recourse to civil mediation pursuant to Legislative Decree 28/2010
· European ODR: For online purchases, access the European ODR platform: Dispute resolution bodies - European Commission
11.4. Complaints:

Article 12 – Final Provisions
12.1. Validity:
In case of partial nullity of one or more clauses, the remaining provisions shall remain fully valid and effective.
12.2. Amendments
Any amendments to the GTC will be communicated by email to registered customers and published on the website with at least 30 days' notice.
12.3. Language:
These GTC are drafted in Italian. They may be translated into other languages for EU customers, but in case of discrepancies, the Italian version shall always prevail.
